Legal Question in Criminal Law in New Jersey

simple assault in self defense

I am 22, a 25 yr old girl hit my husband and then came at me so i pushed her away she pushed me so i pushed back again and then we got into a scuffle and I ended up punching in self defense.....leading to a black eye . One week later the girl and her father and a few other men came to the beach where I was and was threatning my husband and I, the last thing said was they will see us in court. Where do i stand?

Self Defense, and more so in this case defense of others is a defense for criminal and civil liability... now that being said that in and of itself will not preclude charges being filed against you criminally, or civilly... and it would be your attorneys resposnsibility to raise those defenses...

I would suggest you hire an attorney and prepare for the worse, as if you are arrested and criminal charges are brought against you then your attorney can be ready to start work as soon as you are arrested, and possibly save a lot of grief and time awaiting arraignment, in jail, which may potentially be avoided.

You should get an attorney. It appears that they will be filing a criminal and/or civil complaint against you. Either way, you should be prepared.

My initial consultations are always free, so call me at 732/247/3340 to discuss your case.
