Legal Question in Criminal Law in New Jersey

simple assault

My fiance and I have a problem. We have had issues with a 19 year old girl who hangs out with my daughter. She has called DYFS on us and ofcourse there was nothing found, I just have a 17 yr old daughter that is a problem child, but I love her and am trying to do what's best. This summer my fiance took a 2nd job at a restaurant and this girl happened to work there. Most recently, my daughter became pregnant, and alot of other things have happened. So my fiance went in to pick up his check and said to her: '' Do you have your ears on little girl, leave my family alone.'' and she proceeded to curse at him and tell him to get out of her face and he had 5 minutes to do that. Then her brother called him an old man and threatened to beat him up out back. He is mature ofcourse and left. So the girl went to the police station and turned on some tears and they had her file a ''simple assault'' charge. Since when can't you tell someone to leave your family alone? Does anyone have an answer to this crazy question? If this is the case, the courts will be awfully busy!

An assault means that there was some type of physical contact between the parties. It does not mean just telling someone to leave you alone. I would have to see the police report to find out why your fiancee is charged with assault. False criminal complaints are filed. He must defend himself and can consider filing some sort of cross

complaint against her based on her actual conduct toward him. Hire an attorney.

Unfortunately, the criminal justice system is not perfect, and you are getting a first hand look at one of the flaws.... anyone can be arrested/charged at any time with very little (or no) evidence

You can take comfort in the idea that a person is innocent until proven guilty beyond a reasonable doubt.
