Legal Question in Criminal Law in New Jersey
simple assault/ juvenile
My daughter ( 15 yrs.) hit a girl who is the same age as she. Now she is being charged with simple assault. My daughter admitted to the police that she did do it. This is her first offense. What could happen to her?

If this is her first offense she could receive first offender treatment or be placed on probation.
Call me if you like.

It depends on whether it is counsel madatory. If not, you will more than likely be offered the one year rule. If that isn't offered, there will probably be a term of probation.

Re: simple assault/ juvenile
Due to her age and the charge, it is probably not the end of the world. However, it could get worse if she gets on probation and violates it, etc. I suggest you contact an attorney sooner rather than later. It shouldn't be an expensive matter to handle. I can refer you to a good attorney if you would like.
Re: simple assault/ juvenile
She will have to go to family court to have her criminal charge heard by a judge. She is potentially facing high fines and at least in theory some time in juvenile detention. However, if she has no prior juvenile criminal record she most likely will not be sentenced to any detention. Nevertheless the judge will probably require that she be represented by a lawyer, either a private lawyer or the public defender. I am an attorney who has handled many cases similar to yours in various courts throughout NJ in the past. Please contact me to discuss this matter in more detail. I never charge for simply talking to a perons about their case. Thank you.

Where does she have to appear? If it is at a local, rather than county, level, my office can probably assist in a great number of ways. At County, we will still have options based on the lack of criminal history.
