Legal Question in Criminal Law in New Jersey

Simple Assult

My nephew is 18 and as a result of horse play in the school gym injured another student. It was an accident but the parent of the injured student is taking it to court. The charge is simple assult and should my nephew plea guilty or innocent?

If I understand the facts, horseplay suggests that they were both involved so there may have been consent to the touching and your nephew may not be guilty of assault.

Besides that he has to think about how a guilty plea might affect his future.

He should see an attorney as soon as possible to advise him of his rights.

He should plead NOT GUILTY and consider hiring a lawyer. He is facing having a criminal record if he is convicted and no 18 year old should have that following him around for the rest of his life.
