Legal Question in Criminal Law in New Jersey
Speedy Trail Continued
This is in addition to my previous question, If NJ does not have a Speedy Trial Statute, then does that mean that in order to assure a citizens constitutional right to afair and speedy trial, does then the state have to follow the Speedy Trail act of 1974? Thanks again

New Jersey follows the federal case law which requires that a speedy trial motion be made before the issue is properly raised. Once an Order is entered defining the time frame for a speedy trial the failure to have a trial within that time frame becomes of Constitutional magnitude.
