Legal Question in Criminal Law in New Jersey

Speedy Trial 3

I have been doing research on speedy trial for a family member. I have come up with a few websites that state that in NJ a case must be brought to trial within 180 days. what it does not state is does that mean from time of arrest or from idictment. I really need help with this.. And that to determine a vilolation of the right, to follow the factors discussed in Barker v wingo (1972) Please help...

I suggest your family member get a good attorney and that you take his or her advice. Speedy trial is never really an issue in NJ. What is his or her prejudice as a result of the delay? Most case take about a year to go to trial. When the case is more serious and the attorney is good, it takes more than a year. We actually have a case that is over 4 years old right now. Its the oldest case in the county. I honestly think you are wasting your time and that your tims would be much better spent researching the evidence and substantive issues in the case.
