Legal Question in Criminal Law in New Jersey

Speedy trials in NJ

I need info about speedy trials in NJ. Here is the situation, Family member arrested on Jan, 3, 05. Grand jury indictment came on April 16, 06. Lawyer recieved Discovery in which all statements, evidence, etc was dated May 2005. Since, april, the family member has had numerous status hearings with four differant judges, and a new judge scheduled for the next. Motions were submitted in August, and resubmitted in September due to the prosecution had no idea they recieved the papers: (fax and mailed) The prosecution failed to answer the motions as ordered by judge number 4; which will be two months this november 28, the scheduled motion hearing day. As of now, and with each new court date scheduled, the prosecutor, which is also the fourth prosecutor, has not showed at any scheduled dates, and the prosecutor that is present seems to know nothing. My son's life is hanging in the balance, He has a great lawyer, and he says not to worry, but i need to know the rules concerning fair and speedy trial in NJ. HIs lawyer had to resechedule twice but the time between each was a matter of 7 days each, I would assume that the amount of time that had passed canbe considered a violation of fair and speedy trial in NJ. What do you think?

Re: Speedy trials in NJ

Its very difficult, almost impossible to get a case dismissed for lack of speedy trial. Time is on your side anyway. If you say you have a good lawyer, all questions should be directed to him. Trust his advice.
