Stalking

Whether you can plea bargain to a lesser offense or not is up to the prosecutor. The prosecutor typically makes a plea offer. You, in turn, can accept that offer and enter your plea; you can reject the offer and proceed to trial; or you can make a counteroffer.

Before you accept any plea offer, you should explore other alternatives. Other alternatives that you should explore are simply pleading not guilty and having a trial or, alternatively, some "diversionary" program, such as pretrial intervention (PTI).

Re: Stalking

Whether or not you can secure a plea bargain will depend upon the particulars of your case. Some of the following may be important factors: relationship to victim, level of violence, if any, level of threats, if any, etc. These factors may not all be important to your case and there may be other important factors as well.

I handle these types of cases and offer free initial consultations. If your case is in South Jersey, feel free to contact me at your convenience.
