Legal Question in Criminal Law in New Jersey

Out of state arrest

My brother has criminal charges in New Jersey that he ''ran'' from. He has been living in Texas for about 2 yrs. now. He has turned his life around, but I fear that this will come back to haunt him. Will NJ go to Texas and get him for these charges? He is a first time offender. The charge are credit card theft and Identity theft. Thanks for your help.

Yes, your brother can be arrested in Texas for the charges out of New Jersey. The best thing for him to do if he wants to resolve these charges is to first hire a lawyer in New Jersey who can then work with him to get himself turned in without having to be transported from Texas in custody.I am an attorney who has handled many cases similar to this in various courts in New Jersey in the past. If your brother "ran" from the charges then there is an arrest warrant out on him. At some point, your brother will encounter the police and be arrested and returned to the NJ penal system pending trial. The fact that he "ran" will work against him in a bail hearing. Your brother would be wise to contact an attorney back in New Jersey and consult with him regarding his options for surrender and scheduling a time to deal with these charges.

The charges sound serious; they are probably indictable offenses. Arrest warrants for indictable offense are enforced country wide. If for some reason some police officer runs a criminal check on your brother he will arrest him and he will be extradited to New Jersey.

Yeah, I suggest your brother get an attorney to handle these charges if he really wants to put a cap on that part of his life and put it behind him. As a first offender, he could avoid prison time and "possibly" even a felony record.
