Legal Question in Criminal Law in New Jersey

state trasfer of probation

my son was on probation in ca and we had it transferred to NJ where he now lives. He was just charged in a domestic case with disorderly conduct and malicious mischief. Both misdimeanors. I think this violates his probation. Will he be sent back to CA to serve the rest of his probation in jail

Re: state trasfer of probation

Usually, the authorities wait for the disposition on the new criminal charges before filing a violation of probation complaint. A dismissal should cure all.

Probation may report the arrest itself as a violation of probation. It would then be up to the CA courts to decide how to handle it. Call me if you would like to discuss it further at 877*688*3879.

Re: state trasfer of probation

You assume he will be found guilty. I suggest you get a good NJ attorney to work to defeat the charges. If that happens, you don't have to deal with probation in CA. Call me at 732/247/3340 to discuss.
