Legal Question in Criminal Law in New Jersey
suit against dui
i was hit by a drunk driver and disabled, and i was told by a civil suit attorney that i could not sue her because i too had been drinking. We were both tried and held guilty of dui. therefore i cannot sue her because this is a ''no fault'' state. is this true? rita

Re: suit against dui
I suggest you repost your question under personal injury. The finding of guilty cannot be held against you because it was a lower court. A plea of guilty is a different situation.
