N.J.S.A. 2C:21-5c, bad checks, is categorized based on the amount of the check. Less than $200.00 is a disorderly persons offense punishable by up to $1000.00 fine and six months incarceration. Usually for a first offense there is a fine along with restitution(you have to make the check good). Sometimes probation and in certain aggravating/ repeat circumstances, some county jail time. If the amount is $200.00 or more, then you will be advised of your rights and the matter will go to the county prosecutors office to review for possible indictment. Indictable matters are under the jurisdiction of the county courts and not handled in the municipal courts. Obviously the consequence are also greater.(State jail probation ect.) In all cases your appearance at this time is for the purpose of advisement of your rights including your right to be represented by an attorney. You should seriously consider that option.
