Legal Question in Criminal Law in New Jersey

Summons

Spouse receives a summons to municipal court for a complaint on not keeping property safe, clean(pool cover was drying on the ground in the backyard and a neighbor probably complained about mosquitos). The summons was issued to my husband with court appearance required checked off. My husband cannot get off of work from a new job. Can i attend and/or how can we get this postponed?

He also has unpaid motor vehicle court fines with a warrant issued. Can they check this out in a court matter of this type.

No, you cannot go on your husband's behalf if the summons was issued against him. You should try to contact the court and have this rescheduled for a time that is more convenient for your husband. And yes, any outstanding warrants against your husband will appear when he goes to court on this case. He may also end up being arrested on these warrants if he doesn't take care of them before the court date on the unsafe property matter. I live near you, so I'm sure I know what court and judge are talking about. I was actually in front of him today. At this point, getting the case put off is going to be very difficult by yourself. An attorney should be able to get the case put off and you should get one to deal with the warrants because he WILL be arrested otherwise when he does show up or even before. The Ocean County Sheriff's office does not mess around when it comes to people with warrants. I'm sure you have seen the list of people who get picked up in their big sweeps.
