Legal Question in Criminal Law in New Jersey

Terminated from job for past criminal activity

I was fired from my job yesterday due to shoplifting charge four years ago. I was caught with someone who shoplifted. It was a petty misdemeanor. Is it a criminal charge? Can I be fired for falsely answering the question on the application referring to criminal charges? Thank you!

Yes you can. I suggest that you hire a criminal attorney to file a petition for expungement. This will get the conviction of of your criminal record.

While I do not practice employment law, my understanding is that you can be fired for any non-discriminatory reason if you are an "at-will" employee meaning you have no employment contract.

My practice, however, includes the expungement of NJ criminal records. I can assist you in totally clearing your NJ record so that it will not be an issue any longer when applying for jobs. Once an expungement is completed, for most jobs, you will be able to legally state that the arrest/conviction never took place.
