Legal Question in Criminal Law in New Jersey

Terroristic Threat To Kill

Yesteday a group of teenagers snuck into the movie theater that I work in as a supervisor. During the effort of getting them to leave one of the girls who knew my family said to me ''Thats why your Brother was Murder!'' I asked her to repeat herself. During the heated exchange of words I did not threaten her directly. I did ask my boss to get her out of the theater or I would hurt her. The group was removed from the lobby but stayed in the parking lot. The girl continued make gestures at me throught the window. The Police soon arrived and took statments from everyone involved. The Officier told me the girl intented to file a Terroristic Threat To Kill Complaint against me. I later realized that I forgot to tell the officer that she said she was a certefied fighter and threatened to split my face. What if any action should I take now? If I recieve a Subpoena what should I do?

Re: Terroristic Threat To Kill

The two attorneys who answered this question are experts and I always respect their opinion. I don't know what town you are in, but here in Philadelphia, I'd be really surprised if the D.A. wanted to waste their time with insults and the female karate threat. Still, Gary and Jeff are absolutely right in that IF they follow through and file charges against you, you should retain private counsel as soon as possible.

Re: Terroristic Threat To Kill

I suggest you speak with an attorney ASAP. The cops may be calling you back when the girl files the complaint and will want to take another statement from you. I would not want you saying anything to them and I would want you to take action against her. Bottom line is, you really need someone to walk you through this from the start since it will be a lot easier then trying to pick up the pieces further down the line. That complaint she is filing is a third degree felony, so you should treat it very, very seriously.

My intial consultations are always free, so call me at 732/247/3340 to discuss your case.
