theft charge
i was charged with 3rd degree theft in nj i wanted to know what would be the least and the most amount of punishment that i would recieve

Best case, you walk out with nothing but bills from your attorney. Worst case, 5 years in prison.

The penalties can range from: admission into the pre-trial intervention program if this is a first offense, to 5 years in State prison. The latter would generally occur if you had prior convictions.

The maximum sentence for third degree theft is five years in prison. If you are a first offender there is a presumption of a noncustodial sentence, meaning no jail.

There is no definite answer to your question. The MAXIMUM is five years in state prison, but the minimum would be determined when the whole case is worked through by your attorney. Depending upon the facts of the case it may even be possible to get the charge dismissed completely.
