It is all a matter of the value of the item stolen.

If the value is under $200 the maximum sentence is six months. If the value of the item is between $200 and $500, the maximum sentence is eighteen months in jail. If the value of the item is $500 and less than $75,000 the maximum prison sentence is five years and if the the value of the item is $75,000 or more the maximum prison sentence is ten years.

That depends upon the dollar amount you are accused of stealing. The higher the dollar amount, the greater the likelihood you will be doing some jail time.
