Can a theft be expunged?
I was convicted in 1998 for
theft unlawful taking. I am
currently employed but looking for another job because of future lay-off's.
Is it possible to have it expunged?

If the charge was for a fourth degre or higher Superior Court case of theft, then you have ten years from the date you were last on probation or parole before you can file for an expungement. If the charge was for a disorderly persons theft and the case was heard in the municipal court, then you have five years after you were last on probation or parole before you can file for an expungement. If it is expungable, it is important to point out that the process takes between 2 to 3 months. (if not longer in some counties). I charge a flat fee of $850 for expungements. I can be reached at 201/646/9600.

You theft charge was handled in municipal court it was a disorderly person offense and can be expungned five years after the last event of your sentence, meaning the payment of the fine, completion of the service of your probation or the service or the custodial sentence imposed.
If the matter was handled Superior Court, making it a crime you must wait ten years after the last
event of your sentence in order to file an expungement petition with the Court.
