Time to Indict

How long does the prosecutor have to indict someone from the dtae of arrest? My client was arrested July 7, 2002, but was not indicted until February 15, 2003 in Bergen COunty, New Jersey.

This is not NY, where there is a 60 day time limit. There is basically no set time set in stone. The rules allow for a speedy trial hearing. But as far as indictment, as long as there is no prejudice to defendant (for instance, he's in jail, etc.) or defendant's defense, they can take their sweet time. That time frame you mentioned is the usual.

Unlike New York State, New Jersey has no 90 day period for indictment; it has only the right to a speedy trial which is triggered by the defendant's motion for a speedy trial. No speedy trial motion and there is no violation of the right to a speedy trial
