Time limitation
Is there a time limitation under which a merchant can bring a request for reimbursement under NJSA 2c:20.20? At the time of the incident, my niece was told that if they were going to request reimbursment, it would be made within 60 days. Now, 6 months after the incident, she has received a letter. Furthermore, their letter states that it does not precude them from them pursuing a criminal prosecution yet the statute states that it the penalty was paid, they would give a release.

If you are being told by the merchant that there will be no criminal prosecution if it is paid a civil penalty AND she is guilty of shoplifting you should pay the penalty immediately because
a conviction for shoplifting, as would be the case in any kind of theft, will be a bar to employment by an insurance company, bank, brokerage firm, computer and many other employers and may bar becoming an attorney or doctor. In any event, if they did not have her arrested and have not filed a criminal complaint against her she dodged a very LARGE bullet and should thank God.
