Legal Question in Criminal Law in New Jersey

First Time Offense Loitering with an Intent

I posted this case before and got some very useful answers but I believe I was not specific. I was arrested in Paterson, NJ about a month ago for ''Loitering with an Intent to purchase drugs''. I appeared before the judge and pleaded not guilty and have to go back tomorrow morning for trial. I am not guilty of this charge and have never been in trouble before and would just like to know what is most likely going to happen tomorrow. I realize it is too late to hire a lawyer so I am just looking for advice as to what the judge will most likely do if she finds me guilty. Is the 6 months in prison likely? Will I lose my driver's license I was the driver? Being that I am innocent and this is my first time in trouble with the law, I'm just looking as to what I should expect.

Re: First Time Offense Loitering with an Intent

You asked for what could happen, 6 months is possible but its most likely not going to happen since it is your first time. Keep in mind that it is never too late to get an attorney. If you tell the Judge you want an attorney and that you promise to retain the attorney that day, I'm sure he would comply. Its your right to have an attorney, and I'm actually amazed that a Judge would allow you to proceed without one.

PATERSON MC Is a different world. I practice law in this area. The Judge may allow you to proceed after explaining your rights to have an attorney. I WOULD PROMISE THE JUDGE TO GET AN ATTORNEY RIGHT AWAY. EXPLAIN THAT YOU ARE INTERVIEWING ATTORNEYS AND THAT YOU WILL HAVE AN ATTORNEY BY THE END OF THE WEEK. I DO NOT RECOMMEND REPRESENTING YOURSELF. YOU ARE FACING A POSSIBILITY OF JAIL TIME AND IT IS NEVER RECOMMENDED THAT YOU GO WITHOUT AN ATTORNEY.

I WILL BE IN THE OFFICE IN THE MORNING AND IF YOU HAVE ANY QUESTIONS YOU CAN CALL ME FOR A FREE CONSULTATION.
