Legal Question in Criminal Law in New Jersey

just a question my son was caught on school ground with a pellet gun he is being charged with weapons charge now he was released to me and he has another hearing it's called a counsel mandatory plea hearing . what i want to know is what is that ? what happens in that hearing and do you think my son has any chance of not going to jail. he just turned 16 in october he has no criminal records has never been in any trouble he has no behavioral problems with the school. he brought it because some kids told him he would be jumped at the bus stop by a group of other kids and he thought he could scare them away if they saw it. it was not loaded there were no bullets with it . it was in his book bag and he had not pointed it at anyone or tried to harm anyone. he made a stupid mistake out of fear and he should have come to us his parents but he didn't he wasn't thinking. is he going to have to suffer for this . they already kept him in juvenile detention center 6 days before they released him . please help i don't know anything about the juvenile court system and what to expect. I had applied for a public defender when my son was released but now the letter says i have to apply for another public defender . what happened to the other one.

Notice has been given that an attorney is required because your son is in significant trouble. He can avoid further detention but he may not. It is fortunate that your son had an unloaded gun and no ammunition
for the gun.
Your having to reapply for a public defender may just be a bureaucratic mistake. You should call the public
defender's office for an explanation.
If you are considering hiring an attorney for your son I would charge a reasonable fee. Ocean County is some distance from my office but I have handled case in Ocean County before and would be glad to do so again.
