Legal Question in Criminal Law in New Jersey
Trespassing on a Roof
I'm 16 and I was wondering what you would be charged with or what police would do if they found you just sitting on the roof with of an apartment building with friends?

Re: Trespassing on a Roof
It all depends on how you and your friends got to the roof. Did you break a lock or kick in a door? Did you do any incidental damage in climbing to the roof? Was there a sign saying
that you should not use whatever means you to get to the roof? Did you enter upon private or public property where you had no legal right to enter? Where you smoking marijuana or ingesting illicit drugs while you were on the roof? Had the landlord or person in possession of the property warned to not to enter the primises, including the roof? Such conduct might give right to possible criminal charges for trespass;
burglary; malicious mischief or the illegal use or possession of a controlled dangerous substance.
