Legal Question in Criminal Law in New Jersey

Urgently Seeking help for a Innocent South-Asian couple falsely charged with

Incidence had happened in Feb.2002.I was ironing clothes on a small ironing board on the floor. To attend my younger one,I switched off the iron and placed it in upright. My elder daughter was also playing with a ball while doing her homework;the ball slipped from her hand and came near the iron.As she was about to jump to pick up the ball, my husband pulled her hand to sit her down She lost her balance and fell on the board and the iron toppled on her right thigh and left a light scar. Two months later,at her school as her friends were asking her for tatoo, she showed that mark and told them that her father did it. After that the Police arrested my husband.they arrested me for blaming my daughter, whereas I never said anything that would hurt or blame her.We are out on bail.Right now both children are with me for last one-year The DYFS worker and psychotherapist met us frequently and they are completely convinced with our innocence. My husband is also attending Parenting classes. Now plea offer is 3 years imprisonment for my husband and probation for me.My husband is on Non-immigrant H-1 visa I am on dependent Visa.If there is any possibility in this stage, we are ready to permanently return to India (Deportation)asap.

Sounds like you might be best off going to trial, and not pleading guity, if in fact you are innocent, and a guity plea could lead to your deportation.

Run your case by the following immigration attorney, and see what he advises:

Sounds like an awful situation, but a VERY defendable case. As you know, if you plead guilty, you will likely be deported. Please call me to discuss.
