Vandalism and divorce

In middle of bad divorce in NJ. Wife has possession of house temporarily due to Pendelite order. Went over to pick up kids for parenting time and gate was smashed, kids told me that Wife's nephew did it on lawn mower. Damage is $1500. Wife submitted to her attorney for me to pay for damage caused by her nephew. question: can I file a vandalism charge with police? can I file a small claim against nephew, minor, and his mother (wifes sister) for the repairs. I did not authorize him on property, I know my wife did, nothing in pendelite court order about relatives. Can i file charges, mortgage is being paid by me.

Why don't you have an attorney. She does, shouldn't you? To answer your question, I don't see why you couldn't file charges, but if it was an accident, the criminal charges will go nowhere.
