Legal Question in Criminal Law in New Jersey

Victim's Rights

My daughter is a victim of sexual contact by her father. She was 4 years old at the time. She has disclosed to CPC, DYFS, the investigator, etc. The prosecuter is closing the case despite the reports etc. because of her age. He is already a convicted sex offender and on probation. Can I force the issue to Grand Jury or do I have any other options to ensure he does not get away with what he did to my little girl?

Re: Victim's Rights

If your husband is already a convicted sex offender on probation then you can contact his probation officer to report this. This could very well be a violation of his probation. When someone is convicted of a sex crime against a child part of their probation is usually that they are no longer allowed to have any contact with any children. Since your husband has had contact with your daughter, this would likely be a violation of his probation. Also, when you say The Prosecutor, I assume you mean the assistant prosecutor assigned to this case. You can request a meeting with the senior county prosecutor in your county to discuss your concerns and find out the full reason why your husband is not being prosecuted for this new offense. If you have any more questions about this or any other legal issue please give me a call at 1-908-272-0111. Thank you.
