Legal Question in Criminal Law in New Jersey
Did i violate my Conditional Discharge?
I was given Conditional Discharge for a cocaine charge. Three months after the judge made that decision, i was charged with consuming alcohol under the age of 21. Does alcohol consumption violate my conditional discharge or no??

Re: Did i violate my Conditional Discharge?
I would say that a conviction for underage consumption of alcohol is basically a charge based
on consuming a banned substance, a banned intoxicant. On the other hand you should oppose any effort to throw you out of the first offender program by arguing that alcohol is not the same kind of banned substance as that for which you were granted first offender treatment.

Mr. Moore is dead on. You said you were charged, but were you convicted? That's the important point. If the charges is pending, get a good attorney and fight this!
