Legal Question in Criminal Law in New Jersey

violation 2C 35-10a(4) NJ

My friend was in a VFW parking lot hanging out with others before a concert. They were passing around a joint when undercover cops came. One guy who had the j in his possession was arrested and so was my friend as it was outside his car and they searched it and found a small nug. He's wondering what he needs to do? Does he need an attorney? What are the penalties? This is his first offense.

There are ways to possibly beat and probably minimize the penalties he is facing. The maximum penalties are $1,000 in fines and several hundred dollars in mandatory state assessments, as well as 6 months to 2 years loss of license and up to 6 months in jail. I suggest he get one, or at least speak with one. The judge may even force him to get one. If convicted, he could lose his license for 6 to 24 months in addition to other penalites. The criminal conviction alone could haunt him for many years in the future.
