wait time before expungement

Is there any waiting period after a conviction to apply for an expungement? It has been several years since my son, then still a teenager, was convicted of a felony (drugs), and now fails a background check for any job he is being considered for. He has completed rehab and probation and has not been in any trouble since.

If he was convicted in the local Municipal Court, then the waiting period is five years with certain restrictions. If he was convicted in the county superior court, the waiting period is ten years, with certain restrictions. If you would like to discuss this further please contact me. Ten years after the sentence is served

and/or probation is completed and any fine paid application can be made for

the expungement of a felony conviction.
