Legal Question in Criminal Law in New Jersey

warrant

I bail my son in a drug related case, after a few court visits, he fail to appear in court. A month ago he was arrested and served 1 month in jail in N.Y. When he was about to be release a warrant was found from N.J. Oh, in N.J. they had offerred hime 1 year of probation. He wants to know what awaits him, jail or porobation, please help me help my son

Based on the information in your message it is really impossible to say at this time what sentence he would receive. In addition to the original drug charge he now has a new charge for failing to appear in court. This could result in a taking back of the original probation offer and a new offer covering both cases being made. I would need to speak with your son to get more details about his case. Your son is subject to a detainer. Many more facts are needed to answer your questions like what was he charged with and does he have any prior record and in what court are the charges.

Because your son is the one with a legal problem he should immediately consult with counsel and be prepared to present any paperwork and answer these and other questions.

depends on numerous issues. His deal could be off the table and they could charge him with bail jumping. I was in court today and they had nothing but people with bail jumping charges.

I suggest he get an attorney ASAP.

A warrant means a failure to appear. The question is what did he fail to

appear for. If he as offered probation it might still be possible depending on a number of factors including the reason for the issuance of a warrant. I need more information.
