Legal Question in Criminal Law in New Jersey

Warrants for missed court appearance

I have been notified through the company I work for that there is a case that has not been disposed of. So I called the court in N.J to get info and they said my date in court was missed and that they notified me through the mail. I have not recieved any notification since the address that this was sent to does not fit mine. I was arrested without any i.d isn't there a need to get proper identification before releasing an inmate from county jails? if so how is that the address of my i.d does not match the mailing address of my ''COURT'' appearance and how valid is this warrant when i have been incarcerated a few times since this warrant was issued? Is there anyway possible that this can be handled without personally going to court and paying this fine, and or face jail time?

Re: Warrants for missed court appearance

You have not provided any detail as to the charge against you and the Court that you are before. I would not place any faith in the wrong address being written down.

Generally, you have to appear on most charges (unless very minor such as a parking ticket) especially if there is a warrant for failure to appear. But as each case turns on the facts, e.g. you reside out of state, there may be some circumstances that cause a different answer.

I suspect that the best answer is to gather all the facts and consult with counsel. Otherwise you may find yourself arrested one day when you least expect it.

Re: Warrants for missed court appearance

I can't imagine how the court got a wrong address for you unless it was an old address you had. You don't even say what the type of charge was and in which type of court, Municipal or Superior, the charges are from. This is all important information that I would need to know. In general, you do have to appear in court in New Jersey if you have charges out of New Jersey. For certain types of municipal court cases you can plead guilty by an affidavit and avoid a court appearance, however. When you were arrested the police should have asked you for your correct address so they could give it to the court and you could have avoided any further arrests because the court notice was sent to the wrong address. I really would like to speak with you about the specifics of your case so I could give you better advice. Please call me at 908-272-0111 to discuss this in more detail. There is never any charge for simply talking to me about your case.

Sincerely yours, -Ronald Aronds, Esq.-
