Legal Question in Criminal Law in New Jersey
Wasting my time?
2 months ago I had a car run up my bumper and when I wouldn't go faster tried to run me off the road. I got their license number, car color and make. I even followed the car down three streets right to the owners work place. I went right to the police station and they filled out a report and gave me a subpoena to be a witness. The first time there the driver's lawyer said I should talk to him, asked tons of questions, I answered, thought I had to. When it came to standing before the judge to see if there would be a trial the lawyer who in the hall had offered for their client to apologize if I dropped the case now stood before the judge saying he had 3 witness saying his client was in their presence at the time of this happening. I have always been raised to get all the info then get the police. Am I wasting my time, does the plate number, color and make and following them to the parking lot not mean anything? We have a court date when I will testify in 2 weeks. I just wanted to know if next time I should just let someone with road rage go on their way. I've had to take 2 days off of work only to have this person get a lawyer and nothing happen. I'm so new to this, do I have a chance of having this person get anger help

Re: Wasting my time?
If you have a court date, I presume it's because you charge him with tailgaiting (a 5 point ticket). Or you charged him with something else, I don't know. So, the end result of court would be that if the Judge believes you, he would end up with points on his license and a couple of hundred dollars in fines. If you want anger management, you're wasting your time. If you want a learning experience regarding court matters, then you'll be learning that court ain't T.V.. It sounds as if the lawyer got you to admit that you couldn't give a very good description of the driver, just of the car. That's why he is using an alibi defense;because anyone else (but the owner)could have been driving the car. Don't be surprised if the case gets postponed 1 more time the next time. It's not unusual.
