Legal Question in Criminal Law in New Jersey

My wife has been ordered to pay restitution on an engagement ring that she sold. The plaintiff requested restitution of $10,000 and the judge told her to produce an appraisal. She gave the judge a very detailed certified appraisal that was dated 9/28/2010. The ring was sold over a year ago, and we need to know if this appraisal is valid since there was no ring to examine by the appraiser. We want to dispute this judgement amount - any advice on what to do would be greatly appreciated.

I gave you a partial answer. If your wife was ordered to pay restitution that means she either plead guilty or was found guilty of theft with respect to the ring. Again, i am not fully clear of your situation because you do not seem to know if it is civil or criminal, if it is criminal, then the other person is not a Plaintiff, but an alleged victim.. If the other person is suing you civilly claiming that your wife misapproproated the ring, why can't you produce evidence of what it was sold for? Better yet why don't you in this situation consult a lawyer directly to explain all the information to that person, you cannot rely on anything you are told on this site because there is no attorney cleint relationship between you and any attorney who will make an effort to answer your question. If your sitiation is criminal, can I assume that your wife defended herself without the assisatnce of a lawyer? Go and consult a lawyer directly, because then maybe you will get the answer you seek. good luck.
