Legal Question in Criminal Law in New Jersey
How to Withdraw a Guilty plea
I accepted a plea bargain on a criminal matter 3rd degree gambling charge and hindering a investigation. I am scheule to be sentenced to a 5 year prison term shorthly. I only accepted this plea agreement as my attorney told me he spoke with all witnesses and they were going to testify against me. I have since learned that the witnesses never spoke with my attorney or his investigator and they stated they were not testifying against me but for me. My question is now, can I release my attorney and file on my own to witdraw my Guility plea? How do I do this through a motion? Please help, thank you.
