Legal Question in Criminal Law in New Jersey

work out of state on probation -need quick answer

My son was before a superior judge in county court and received 1 year probation but the judge indicated in the judges order that he was permitted to work out of state but had to check in with probation at every port. His probation officer called him in Florida and told him he had to come back permanently because of some kind of law and did not care about the judges specific order. Can this happen? My son's attorney will be speaking with the judge.

If your son already has a lawyer then he really should be able to answer your question for you. I don't know what your son was convicted of, but I also don't know of any law that would completely prevent your son from working our of state. What he would need to do is get permission to have his probation transferred to whatever state he moved to. Once he gets that permission, then he shouldn't have any problems. However, once again, I urge you to consult the lawyer that you have already hired. Thank you.
