Legal Question in Criminal Law in New Jersey

wrongfully accused

I was in a van with 2 others.1 held pot and cigarette papers.I held nothing.I was charged with possesion of cigarette papers with intent to use with drugs.Charge #2c:36-2.Keep in mind that I held no drugs or cigarette papers.Thank you in advance.

Usually, all occupants are arrested where your scenario exists. The officer lets the prosecutor sort out the defendants, if he thinks it appropriate.

Generally, all occupants of the vehicle are charged with constructive posession - the ones most likely to be prosecuted more heavily are the driver and the actual holder of the illegal merchandise.
