Wrongly Charged with Drug Possession

My fiance was arrested for drug possession two nights ago. He went to the corner store, that is in a highly drug infested neighborhood. As he was walking out, the cops came and was breaking up the large crowd in front of the store. As my fiance was walking away, they stopped him and said a bag of drugs that was on the floor, not his person was his. When he was at the jail, they told him he was gonna be there for 2 hours, but it turned into at least 9. The police at the jail that night told him that the charge will be dropped down to wandering, but the paper he has states the charge as possession drugs. His court date is 6/8/04 and he is highly worried that this is gonna get on his record and to his license, which he has to keep clean for work purposes (truck driver). How can he make sure he gets a fair time in court? Is there anything that we may be able to bring up in terms of the charges, his license? Can he check with someone tonight, maybe at the precinct to make sure the charges will in fact be lessen to a wandering charge. Please help ASAP. Thanks!

Not much can be done on such short notice but if he has court tomorrow, it must be municipal court and then he should be able to talk with the prosecutor. They should also give him time to hire an attorney or to apply for a public defender. If you would like to talk more about the charges call 732-286-2170

Without question, when your fiancee goes to court tomorrow he should ask for an adjournment for his case so he can consult with an attorney. Since his court date is tomorrow, it is almost certain that the judge will grant his request. Even a wandering charge can have serious implications, including possibly a loss of license, if the case is not handled properly so he definitely needs to be represented by a lawyer. You don't say what town or county the case is being heard in and if I knew I could give you a better idea what to expect.
