Legal Question in Discrimination Law in New Jersey

Students need not apply?

I work in the Chemistry stockroom at a major university as a part-time employee with no benifits. I have applied for the job on a full-time basis and my department refuses to consider my application because I am a student at the university. They have decided to open the position to people outside the university without considering me. Eventually when they do find someone to replace me I will be laid off. I always thought that major academic institutions are equal opportunity employers and try to promote from within. Is this practice legal?

If you are claiming discrimination against a protected clas, then you must be in that protected class. Some protected classes are race, age, gender, national origin, physical, and mental disability. Being a student alone does not put you in tne protected class to make a civil rights claim. If you fall into one of the protected classes, and believe that you have been denied the position on a full-time basis because you fall within one of the protected classes, then you should file a claim with the EEOC immediately.
