39:3-40 Driving while revoked after DWI conviction penalty

I was convicted of DWI a few months ago and my drivers license was suspended. I was driving and was pulled over in a random license plate scan. I am now charges with 39:3-40 driving while revoked after a DWI. My question is:

What are the penalties I am looking at?

If this your first offense, the penalties for driving while revoked, after being convicted of DWI are a fine of $500.00, an additional suspension of your license for one to two years, and a possible jail sentence for not more than 90 days. Due to the seriousness of the charge, you should seek legal counsel. If you wish to discuss this matter further, please contact me.

The law says that a person convicted of driving while suspended for DWI, in addition to the standard driving while suspended penalties, "shall be fined $500.00, shall have his license to operate a motor vehicle suspended for an additional period of not less than one year or more than two years, and shall be imprisoned in the county jail for not less than 10 days or more than 90 days". I am an attorney who has handled many cases similar to yours in various courts in New Jersey in the past. Please call me at 908-272-0111 if you would like to discuss this further. There is never any charge for simply discussing a case with me.

In addition to the normal driving while suspended penalties because you were driving while suspended from a DUI the state imposes steeper penalties......you get an extra $500.00 fine, your license to operate a motor vehicle gets suspended for an additional period of not less than one year or more than two years, and you will be put in the county jail for at least 10 days. If you wish to discuss this mattetr further call me at 732-286-2170.
