Legal Question in DUI Law in New Jersey

3rd DUI offense in 10 yrs

I have 2 DUI's in PA, and just got one in NJ. All within 10 yrs. What exactly am I looking at after pleading guilty?

The question is what exactly did you plead guilty to in Pennsylvania. If you pled guilty to being impaired and those offenses only required a reading less than .08 blood alcohol content you are a first offender in New Jersey.

To count an out of state dui the required reading for a conviction for same must be .08 or greater in order to be counted as a prior dui conviction. If you pled guiltuy to one offense out of state equivalent to dui in New Jersey your recent dui in New Jersey would be a second offense.

In New Jersey a third dui has a mandatory sentence of six months in jail of which 90 days can be served in an alcohol rehabilitation program.

Why not get an attorney and fight this?

This is serious trouble. The penalties call for mandatory jail time of 180 days and a loss of license for 10 years. It gets worse if you were on a DUI related suspension at the time of arrest.

What City/county did this happen? I practice throughout Southern New Jersey and have more than 15 years experience defending DUI matters in PA and NJ. I can fight to get the penalties reduced if I think I can't win the case.
