Alcotest Certificate of Accuracy
If the certificate of accuracy is expired, would the machine then automatically be proven to be inadminisable in court? In my case the machine was originally certified on Jan 9th 2006 and my test was conducted 8 months after the expiration of the recertification due date. Thanks

With all due respect to the other attorneys, I have to disagree. The alcotest results should not be used in your trial in the first place due to the Chun case. Thus, if they get thrown out its the same end result: the case will proceed based upon the observations of the officer in which case I cannot render any type of opinion as your answer is limited.
Once again, with all due respect to any attorney that you speak with, I would be very careful about an attorney that says lets rush into trial and win this case with this evidence alone. While you are taking the bus everywhere for 7 months you can think back to my response.
My guess is that you are attorney and not a defendant as I can't see how you would get your discovery without an attorney and how you would figure that out. However, if you are a defendant and you need an attorney, feel free to give me a call to discuss your entire case and not just the alcotest results.

It certainly sounds like you may have an actual defense in your case. I'd be very intereseted in talking to you about it.
