Legal Question in DUI Law in New Jersey

alcotest chun case

I was arrested in Feb of 07 . My readings are .03 difference . I have done the math problem that the NJ Supreme Court has forwarded to prosecutors and judges and my reading do not fall inside the tolerance range. It is my second offence , what are my chances of winning my case ?

There are two forms of proof of dwi. One is two readings on a breath testing device. That part seems to be no problem for you. The other form of proof is your appearance and your performance on field sobriety tests.

Your performance on a field sobriety test can be the product of street;

tiredness; your being overweight or elderly or injury. Field sobriety tests

as proof of dwi/dui is NOT a slam dunk.

Much more information is needed before your question can be answered. For example, why were you stopped? Erratic driving? Did the police conduct roadside sobriety tests? Were you able to stand? How did you perform on the balance test. Did you admit to drinking alcohol and did you tell the police how much you drank?
