Legal Question in DUI Law in New Jersey
arrested at home
I was driving and had a panic attack. I am currrently seeing doctors and on medication. I hit a utilitily pole during the attack. I went home and drank. I went back outside. The police arrived and I was arrested for DUI. Is this legal?

As long as the police can show that they had probable cause to arrest you then the arrest would be considered legal. However, they still need to prove their case before you can be convicted of the charge against you. This may not be so easy for them to do based on what you have said in your e-mail. If you drank after you parked and went home, then it cannot be considered drunk driving. Now, if your medication impairs your ability to drive, this may be another issue. I would have to know more facts to better understand the situation. Call 201-646-9799
