Legal Question in DUI Law in New Jersey

My boyfriend got a DUI for allowing his friend to drive his car. My boyfriend was drunk and knew he shouldn't drive. He was unaware that his friend was drunk. Any advice?

In order to convict your boyfriend the police have to show that your boyfriend was aware his friend was drunk. This is a weird rule, but in many states you can be charged with DUI for letting someone else drive your car drunk--even though you were not driving! He needs to defend this case. The Prosecution needs to show that he KNEW that the driver was drunk. If he was unconscious then he arguably could not knowingly allow his friend to drive.
