Caught driving over speed limit
I recently purchased a second car from a friend on Thursday July 6. Because Motor Vehicles was closed at the time due to the state budget crises, I could not register the car or transfer the title. I put a temporary plate on the rear that had been retired from an older car that we had once owned.
On Tuesday July 11th, I drove a mile into Wallington where a mechanic was waiting for me to give me an estimate on the broken driver seat. On my return trip home, an unmarked East Rutherford police car turned on his siren and flahing lights on Carlton Ave., just as I was crossing the tracks back into Rutherford. He pulled behind me as I stopped the car on Erie Ave. in Rutherford and issued me two summonses: 1) For going 15 miles aver the 25mph speed limit, and 2) Driving in an unregistered vehicle. According to the chart on the back of the ticket, I'm staring at a fine of $105 plus points. Is there anyway to minimize the damage (i.e., waive the points or reduce the fee) when I have to appear before the prosecutor in early August? Also, would I help or hinder my case if I mentioned the fact that the policeman chased me outside of his juristiction and wrote up these summonses on Rutherford soil?

You are fortunate that the officer chose not to charge you with fictitious plates. Cut your loses; speak with the prosecutor in court and make the best deal that you can. As for the officer, a citizen could issue a ticket to you, not to mention a police officer who apparently first observed you in his town; ran your plates and saw that the plates did match the car.

Regarding the unregistered vehicle ticket, you may be able to get that one dismissed if you explain to the prosecutor about your attempts to get the registration when the government was shut down. Regarding the speeding ticket, this is a four point ticket. If you go on your own, the prosecutor may or may not agree to lower it to a 2 point speeding ticket. If you go with an attorney you will probably be able to get it lowered down to a zero point ticket with a higher fine. The issue of the officer pulling you over in a different jurisdiction is not a legally valid defense to the tickets. This might be a situation where you should speak with the prosecutor first to see what the deal is and then see if you need an attorney, its up to you.
