driver with permit driving home a lisenced drunk driver

my daughter has a permit to drive and needs a lisence driver in the car with her. Question- can that person who is now the passenger be over the legal alcohol limit to drive as in like drive me home from the bar

Generally there is a time limitation as to what hours the driver with a permit may legally drive.
