driving while on methadone

Is it illegal in New Jersey to drive while taking doctor prescribed methadone?

Probably. Driving while under the influence of narcotics is illegal. Methadone is a synthetic opiate, hence is a narcotic. Even if prescribed by a doctor, you are "under the influence." Further, I have no doubt that your instructions included prohibition on driving a vehicle while taking methadone.

But, even if not illegal, it is foolish and dangerous to yourself and others to drive while under the influence of narcotics. Don't do it.

The offense is operating a motor vehicle while

UNDER THE INFLUENCE OF alcohol or drugs. Unless the drug taking is itself illegal there is no offense unless the INFLUENCE of the drug makes the operation of the motor vehicle unsafe.

If one takes methadone without a lawful prescription one commits the offense of using

a proscribed drug. If the methadone use makes the

operation of the vehicle there is also the

offense of dwi.

A person charged with and found guilty of using a

proscribed drug must suffer the loss of driving

privileges in New Jersey for a minimum of six

months and a maximum of 24 months.
