Legal Question in DUI Law in New Jersey

Driving with open container question

I was recently pulled over and I was

given 3 tickets. The first was

careless driving for not using a turn

signal, the second was an open

container in M/V, then the third

consumption of alcohol in M/V. From

what i understand about NJ law the

fine is $200 for having an open

container in a M/V but I cant seem to

find any information on consumption

in a M/V. I was not arrested just

given the tickets, was never arrested

before and have a completely clean

driving record. Can any one share

some information on what kind of

fines I should expect and if it is a

good idea to get a lawer for this?

Re: Driving with open container question

Having an open container of alcohol in a vehicle creates the presumption that alcohol was consumed while in the vehicle. I need to see your summonses, but I believe that two of your tickets are really one charge. As for the fines, I would expect that the total of fines assessed will be about what I would charge to appear in court with you. I will not look up the specific fines because you did not provide the statute citations and because this is a free consultation.
