Legal Question in DUI Law in New Jersey

DUI in NJ

Saturday I was pulled over by a state trooper for failure to maintain lane, at which point the trooper ordered me out for a field sobriety test battery. I passed the nystramus (sp?) test which involves following an object with one's eyes, the heel-o-toe walk test after politely asking the officer to remove a stick from my path, and the leg raise test. At this point I was put under arrest for suspicion of DUI and driven by the officer to the station. Along the way he flat out told me I wouldn't be going to jail, they would just run the tests and I'd call for a ride back.

After taking the breathalyzer, I blew a .12, and advised the officer I am both underweight (5'9, 125 lbs), and hadn't eaten recently that day due to work. I was told I was welcome to simply lay down in one of the private cells simply to wait for my ride, which I did.

I was issued a ticket for failure to maintain lane, reckless driving and DWI, with a court date.

Sadly, I'm incredibly indigent due to being a college student from a poor family, so I will be forced to hire a Public Defender for my defense.

My question is, do I have a strong chance of getting this knocked down or dismissed?

You may even have to pay a small fee for the public defender. Where did the offense occur?

Without a good attorney helping you in this case, I doubt you'll have much of a shot. Even with one, these cases are never easy.
