dui-dwi charges

two above charges in two week period. license suspensed for 10 years due to an pen container chage nine years ago. court claimed three chares in a 10 year period. can we appeal this or not?

I would have to review your driving record to give you a definite answer, but an open container conviction should not count towards giving you a third DWI conviction. You have 20 days to file an appeal in your case from the date you got convicted, so if you have already been convicted on a third offense DWI and less than 20 days have passed since then, call the court and find out how to appeal right now. After you have done so please contact my office to discuss your case in more deatil. I never charge for simply talking to a person about their case. Thank you.
